Notice-and-Notice Regime

Mediadrive participates in Canada's notice-and-notice regime under the Copyright Act. When we receive a valid notice of claimed infringement from a rights holder:

  • We will forward the notice to you electronically
  • We will retain records as required by law (minimum 6 months, or 12 months if legal proceedings are commenced)
  • We will confirm to the rights holder that the notice was forwarded

You are responsible for responding appropriately to any notice you receive. This may include removing allegedly infringing content, disputing the claim, or seeking legal advice.

Repeat Infringer Policy

We maintain a repeat infringer policy and will terminate accounts that are subject to repeated valid copyright infringement notices. Factors we consider include the number and nature of notices received, whether the customer responded appropriately, and whether the infringement was knowing or willful.
